This privacy notice explains how personal data is processed when you visit cyberfishag.ch or contact us. The Swiss Federal Act on Data Protection (FADP) applies. Separate privacy notices may apply to our software products.
1. Controller and contact details
Cyberfish AG
Industriestrasse 4
8836 Bennau, Switzerland
Email: info@cyberfishag.ch
You can use these contact details for privacy enquiries and to exercise your rights.
2. Providing and protecting the website
We use Cloudflare to host and deliver our website. Technical connection data, including IP addresses, access times, requested addresses and browser and operating system information, is processed in doing so. This data is used to deliver content, troubleshoot errors and protect against abuse. Technical logs may be stored for these purposes.
Further information is available in Cloudflare’s privacy policy.
3. Contact form and email
When you contact us, we process your contact details and information about your enquiry to respond and manage the related communication. Our contact form collects your name, email address and message. A hidden check field helps prevent automated spam submissions.
The form is processed through our website and the enquiry is sent to info@cyberfishag.ch. We use Microsoft 365 for email communication. Microsoft processes message contents and technical communications data as a service provider. Please provide only information necessary for your enquiry.
4. Cloudflare Web Analytics
Cloudflare Web Analytics is planned for statistical measurement of page views and loading speed. When analytics is enabled, your browser sends page views and technical information about browsers, devices and loading times to Cloudflare. Establishing the connection also technically transmits your IP address.
According to Cloudflare, Web Analytics does not use cookies or local browser storage for analytics and does not create fingerprints to recognise individual visitors. Visitors are not tracked across different customer websites. We do not send names, email addresses or contact enquiry contents as analytics events. You can block the analytics script using your browser’s protection features or a content blocker; the rest of the website remains usable.
Further information: Cloudflare Web Analytics.
5. Recipients and international disclosures
Personal data is made available to employees and service providers who need it for the purposes described. These include providers of hosting, IT operations and email communications. Data is disclosed to authorities or other recipients where legally required or necessary to establish or defend legal claims.
Cloudflare and Microsoft operate internationally. Their services may involve processing outside Switzerland, particularly in the EU and the United States. Processing exclusively within Switzerland or the EU is not guaranteed. Information on further processing locations and subprocessors is provided in the provider information linked below.
Disclosures to countries without an adequate level of data protection require suitable safeguards or a statutory exception. The providers’ data protection terms provide for standard contractual clauses and, where applicable to the transfer concerned, the Swiss–U.S. Data Privacy Framework. Details are available in Cloudflare’s data processing terms and Microsoft’s Products and Services Data Protection Addendum. You can contact us for information about the safeguards applicable to your data.
6. Retention and security
We retain personal data for as long as necessary for the relevant purposes. For enquiries, the period depends on their handling, subsequent business dealings and necessary evidence. Technical logs support investigations of errors and security incidents. Statutory retention obligations and the protection of legal claims may require longer retention. Once the purpose for retaining data no longer applies, it is deleted or anonymised.
We take appropriate technical and organisational measures to protect data against unauthorised access, loss and misuse. Complete protection during electronic transmission cannot be guaranteed.
7. Your rights
Subject to the statutory conditions, you can request information about your personal data, its correction or deletion, and the delivery or transfer of certain data. You can object to processing and withdraw consent with effect for the future. Statutory obligations or other legally permitted grounds may prevent us from fully fulfilling a request.
Please send requests to info@cyberfishag.ch. We may request additional information needed to verify your identity securely. We generally provide access information free of charge within 30 days. We will inform you of any necessary delay or legally permitted restriction.
You can contact the Federal Data Protection and Information Commissioner (FDPIC) and enforce your rights through the courts.
8. External links and changes
When you follow links to other websites, their privacy notices apply to processing carried out there. We update this notice when our processing activities or legal requirements change. The current version is published on this website.
